These Terms and Conditions govern the ESP Doodle Design Competition, organized by WellWellWell Investments Pty Ltd (trading as "ESP"). By participating in the ESP Doodle Design Competition, you agree to be bound by the following Terms and Conditions:
1.1 The competition is open to legal residents of South Africa who are 18 years of age or older at the time of entry.
1.2 Employees of ESP (and its affiliates), as well as their immediate family members, are not eligible to participate.
2.1 The competition will run from 12-09-2024 to 24-09-2024
2.2 All entries must be received by 23:59 SAST on the closing date. Late submissions will not be considered.
3.1 To enter, participants must submit an original doodle design that represents South Africa.
3.2 Entries must adhere to the technical guidelines as outlined in the competition announcement.
3.3 Submissions must be original work created by the entrant and must not infringe upon any third-party intellectual property rights.
3.4 Entries should be submitted via email by the deadline.
4.1 The winning entry will be selected based on creativity, originality, and how well it represents the theme of South Africa.
4.2 A panel of judges will evaluate the submissions and select the winner.
4.3 Their decision will be final and binding.
5.1 The winner will receive a new MacBook Pro, customized with ESP stickers.
5.2 The winning doodle may be featured as the official background for ESP Chats in the app. However, if it does not align with our requirements or work effectively for our users, we reserve the right to adjust or not use the winning doodle for this purpose.
5.3 No cash alternative or substitution of the prize will be offered.
5.4 Delivery of the prize is only available within South Africa.
6.1 The winner will be notified via email within 14 days of the competition closing.
6.2 If the winner does not respond within 7 days of the notification, an alternative winner will be selected.
7.1 By entering the competition, participants agree that if their design is selected as the winning entry, all intellectual property rights, including copyright, in the design will be assigned to ESP.
7.2 Upon winning, the participant irrevocably assigns and transfers to ESP all rights, title, and interest in and to the design, including the right to use, reproduce, modify, adapt, distribute, and publicly display the design for any purpose, including but not limited to marketing, promotional activities, and integration within the ESP app and other media.
7.3 The participant waives any moral rights they may have in the design, and agrees not to assert any claims against ESP regarding the use of the design.
7.4 Non-winning participants retain ownership of their submitted designs, but grant ESP a non-exclusive, royalty-free, and transferable license to use their submission for marketing and promotional purposes.
8.1 ESP reserves the right to modify or cancel the competition at any time without prior notice.
8.2 ESP will not be responsible for any technical failures or issues that prevent an entry from being submitted or affect the judging process.
8.3 By participating, entrants agree to release ESP from any liability arising from participation in the competition or the acceptance and use of the prize.
9.1 Any personal information collected in connection with the competition will be used in accordance with ESP’s Privacy Policy and will only be used for the purpose of administering the competition and awarding the prize.
10.1 This competition and its Terms and Conditions are governed by the laws of South Africa.
